Family Terms of Use
These Family Terms of Use (the "Family Terms") are an agreement between McKerin Software, Inc. ("Callback", "we", "us") and you, the person who holds a Callback family account. Clubs use Callback to take registrations, waivers, and payments for their programs and to take bookings for their lessons. You use Callback to register players with a club, book lessons, and pay the club.
Our Privacy Policy explains in detail what information is handled, who can see it, how long it is kept, and how it is deleted. Clubs agree to separate Club Terms of Service, which do not make you a party.
1. Who these terms are with
These terms are between you and Callback. The club is a separate party. The club runs its programs and lessons; sets their prices, places, and rules; writes its waivers; and decides about cancellations and refunds. Callback provides the software the club uses and does not run any program or lesson. Anything you agree with a club, such as a program's rules, a waiver, the club's own lesson terms, or its refund policy, is between you and that club.
You accept these terms by ticking the box that says so when you create your account on Callback's sign-up page, when the Callback website asks you after you sign in, or when you register a player. On a club's Lessons site you are asked the same way when you create your account there or sign in.
2. Your account
- One adult. You must be at least 18 and an adult under the law where you live (in a few states the age is 19 or 21) to hold a family account, and you confirm this when you accept these terms. An account that has not confirmed it cannot register a player. A child may not hold an account. Information about a child is entered by the child's parent or guardian, or by the club.
- One person. An account is for one person. Keep your password private. You are responsible for what is done with your account. Tell us at support@mckerinsoftware.com if you think someone else has used it.
- One account across clubs. The same account works with every club that uses Callback, for registrations and for lessons, and a club can also give it a staff role. The households and players you enter are kept separately for each club, and each club sees what is entered for it. When you first add a household or are given access to a player at a club, that club sees your name and email address, and it sees the household details you enter.
- Accurate information. Keep what you enter accurate and up to date, and enter only information you have the right to give, about yourself and the players you act for.
3. Guardians and shared access
- The person who adds a player at a club becomes that player's guardian in Callback, with every right over the player's record at that club. In Callback, "guardian" means a person with access to a player's record. It does not mean that the person is the player's legal guardian.
- A guardian who can manage a player can edit the player's record and can give another person who has a Callback account some or all of these rights: register, pay, and cancel; receive the player's emails; manage; and, for lessons, book and cancel lessons and check the player in. Give access only to people you trust to act for the player. The club's administrators can also add, change, or remove a player's guardians.
- What guardians see. Every guardian of a player sees the player's record (except the details below) and registrations and the names and rights of the player's other guardians. In Callback's family area, some details are limited. Only a guardian who can manage the player sees or changes the player's medical notes and emergency contact, and sees the other guardians' email addresses (for an adult player, see below). Only the person who made a registration, a guardian who can manage the player, or an adult player linked to their own account sees the answers to the club's questions on it, and only the person who made it, or a guardian who can pay for or manage the player, sees its payment link. A household's contact details and address are seen only by its owner and by members who book, pay, or manage for a player booked from it. A club's Lessons site applies the same rules to medical notes, the emergency contact, the other guardians' email addresses, and household contact details, and it does not show a player's own email address or phone number to guardians. The Privacy Policy lists what each person can see.
- Adult players. A club can link a player who is 18 or older to the player's own Callback account. From then on, only the player can edit the record and give or change access to it (the club's administrators and Callback staff can still change the other guardians); the player can remove any guardian; the player signs their own waivers; only the player, of the player's guardians, sees the medical notes and the emergency contact; and the player sees the other guardians' email addresses.
4. Registering for a program
- A registration is a request to take part in a program that the club runs. The club decides who may take part, how many places there are, when registration is open, and whether there is a waitlist. Questions about a program are for the club. Callback's emails about a registration are sent for the club, and replies go to the club.
- Holding a place. When a program has a price, your place is held for the time shown when you start to pay. If you do not complete the payment in that time, the place is released and Callback emails the player's guardians who receive its emails. You can try again while places remain and registration is open.
- Waitlist offers. If a place opens, the club may offer it to you by email, with a deadline to pay. If you leave the payment page without paying, you can come back and pay until the deadline. If you do not pay by the deadline, the offer ends, the place is released, and Callback emails the player's guardians who receive its emails. A payment you started before the deadline still counts if the place can still be given to you; if not, it is refunded (below).
- A payment that cannot buy the place. If a payment completes when the place can no longer be given to you (for example, because it was released before your payment went through), if the same registration is paid twice, if the registration was deleted, or if the payment was made on a Stripe account the club no longer uses with Callback, Callback refunds that payment to you in full on its own. Once the refund is made, Callback emails the guardians who receive the player's emails (not for a deleted registration, or where the club no longer uses Callback). If the refund cannot be made, the club is told and makes it; where the club no longer uses Callback, Callback's staff are told instead.
- Cancelling. A guardian who can register and pay for the player (for a team, the person who registered it) may cancel a registration that is waiting for payment, waiting for the player's signature, or on a waitlist. To cancel a registration that is paid or confirmed, contact the club.
5. Price, payments, and refunds
- One price. The price shown for a registration is the total you pay. No separate service fee is added when you pay.
- Payments through Stripe. You pay on a payment page hosted by Stripe, our payment processor, which collects your card or other payment details itself; Callback does not receive your card number. The charge is made on the club's own Stripe account and the payment goes to the club, which pays Callback a fee for the service. The fee is included in the price you see; it is never added on top. Stripe processes payments under its own terms and privacy policy.
- Refunds. The club decides whether to give a refund, and how much, under its own policy. A refund the club gives through Callback goes back to the payment method you used. Callback makes refunds on its own only in the cases in sections 4 and 9. If you have a problem with a charge, contact the club first; a dispute you raise with your card issuer is answered by the club.
6. Waivers
- A club may ask you to sign one or more waivers when you register. A waiver is the club's document: the club writes it and is responsible for it. Callback provides the tool for signing it. Callback does not write or review waivers and makes no representation about what a waiver means or whether it can be enforced.
- You sign by reading the waiver, typing your name, and ticking "I agree" to a statement Callback shows from the player's record: "I am the parent or legal guardian of" the player (a player under 18, or with no date of birth); "I am the participant and I am 18 or older" (a player 18 or older, who signs); or, for a team, "I am 18 or older and I am authorized to sign for" the team. Sign only if the statement is true of you. Typing your name and ticking "I agree" is your electronic signature, and you agree to sign this way. If the date of birth in the player's record shows the player is 18 or older, only the player may sign the player's waiver.
- A player who is 18 or older. When you register a player who is 18 or older and is not linked to their own Callback account, you either confirm that you are that player, or give the player's own email address (not yours or another guardian's) and we email them the waiver to sign (if the program is full, once the club offers a place). The registration waits for their signature until a deadline we show you, and nothing is charged until they sign. Once they sign, Callback emails the player's guardians who receive its emails, and if the program has a price you can pay by a deadline, as with a waitlist offer. If our email to the player cannot be delivered, we tell you and say what you can do. If they decline or do not sign in time, the registration ends and the place is released. If the club has linked the player to their own Callback account, they register and sign for themselves.
- With your registration, Callback records the waiver and the version you signed, the name you typed, the statement, that you ticked "I agree", your account, the time you submitted, and the IP address the registration came from. For a waiver a player signs from an emailed link, Callback records the address the link was sent to instead of an account and IP address. Callback keeps the text of every version while it keeps the club's data, and you and the club can read the text you signed.
7. Sharing your contact in a league
A league program may ask whether you want to share your contact. The box says "Share my player's name and my household email and phone with families of every registered player and team in this league season" (for a team: "Share my team's name and coach's name and my household email and phone with families of every registered player and team in this league season"). If you tick it, then while the league's schedule is published or being played, anyone with access to a registered player or team in that league season can see your player's name (for a team, the team's name and its coach's name) and your household's email address and phone number. They do not have to share their own. If you do not tick it, yours is not shown. A guardian in the household that paid who can pay for or manage the player (for a team, the person who registered it) can stop sharing at any time on the registration's page in the family area. Contacts you see this way may be used only for that league (section 11).
8. Naming a partner
A program may ask you to name a partner. When the person you name registers for the same program, they, and the other guardians who can see their registration, see your player's name, the email address of your Callback account, and whether your registration is complete. Check the email address carefully before you submit. If someone names you, you see the same about them.
9. Lessons
A club that uses Lessons has its own Lessons site, where you sign in with the same Callback account. The club sets its lessons, prices, packages, and cancellation cutoff, and may ask you to accept its own lesson terms, which are between you and the club. On the Lessons site:
- Booking and paying. A guardian who can book for a player can book lessons and pay by card, from the household's balance at the club, or by cash or check paid to the club. Paying by card and buying packages also need the pay right. The club may limit how many lessons can be left unpaid in cash or check. A card booking holds the spot for a limited time while you pay; if you do not complete the payment in that time, the spot is released. If a card payment completes after the spot was released, you get the spot back if it can still be given to you. If not, or if the player already holds a spot in that lesson, Callback refunds on its own the part of the payment for each spot it cannot give (all of it if it can give none), and emails the guardians who can pay for your household once Stripe confirms the refund. If that refund cannot be made, the club reviews the payment and decides. A card payment that completes while your family's Lessons data is being deleted, or after it was deleted, is refunded in full on its own (while or after the club's whole Lessons data is deleted, Callback's staff refund it). Other refunds are the club's. A note you write for the coach when you book is seen by the coach and the club and, among the player's guardians, only by the person who made the booking, guardians who can manage the player, and an adult player linked to their own account.
- Payments under review. Callback pauses its automatic handling of a lesson card payment when a refund or dispute on it needs a person: for example the club refunded it from its own Stripe account, your bank raised a dispute, a refund did not go through, or you cancel a lesson on a payment that already had a refund. While a payment is under review, a cancellation is recorded but gives no credit or refund until the club decides. The club decides whether you get credit, a refund, or neither; if you were told a cancellation or refund was waiting, Callback emails the guardians who can pay for your household when the club has decided. Credit and refunds remain the club's decisions.
- Balance and packages. Credit, whether from a package, from a cancelled booking, or given by the club, is kept by the club for your household, can be used only for that club's lessons, and expires on the date it carries. Expired credit cannot pay for a lesson. Depending on the club, the balance the site shows either leaves expired credit out or can still include it; either way, expired credit is not spent. A booking paid from the balance is charged at the cancellation cutoff (or at check-in, if earlier); if the balance cannot cover it then, it becomes an amount owed to the club by cash or check, and the Lessons site emails the guardians who receive the player's emails. Packages are sold by the club under its own rules. Once a package's credit is on your balance, the Lessons site does not refund it; any refund is the club's decision. A package payment that cannot be added to your balance is refunded in full on its own. The site shows that packages are not refunded, and how long the package's credit lasts, before you pay.
- Cancelling. A guardian who can book for the player, in the household that pays for the booking, can cancel a booked lesson until the club's cancellation cutoff, unless the club does not take cancellations online. If it was paid by card, the amount comes back as credit on your household's balance at the club, which also expires; the club may instead refund it to your card. After the cutoff, contact the club. If a booked player does not attend, the club decides whether the charge stands.
- Emails. Lessons emails go to the guardians who receive the player's emails; some emails about money go to the guardians who can pay.
10. Emails
Callback sends emails about your registrations and lessons for the club, to the guardians who receive the player's emails, and replies go to the club. Callback tells you about a new version of these terms when you next sign in (section 12). Send notices to us at support@mckerinsoftware.com.
11. Acceptable use
- Use Callback only to register, book, and pay for programs and lessons for yourself and the players you act for, and to keep their records.
- Do not enter information that is false or that you have no right to give. Do not use another person's account, try to see information you have not been given access to, interfere with Callback, probe or breach its security, or access it by automated means.
- Shared contacts. Contacts that other families share with you in a league may be used only for that league, such as arranging games and league matters. Do not use them for anything else, such as marketing or soliciting, and do not pass them on. The same applies to a partner's or a guardian's details you see in Callback: use them only for the program or player they concern.
- We may suspend or close an account that is used in breach of these terms or the law. We will tell you by email unless the law or a security risk prevents it, and section 15 explains what happens to your information.
12. Changes to these terms
Each version of these terms has a version identifier and date. We keep a copy of each version we publish. If we change them materially, we post the new version here, and the Callback website asks you to accept it when you next sign in to your family area or register a player. A club's Lessons site asks you when you next sign in there. Until you accept a new version, the version you last accepted continues to apply to you. A new version does not apply to a dispute that arose before it took effect. Until you accept it, you cannot register, pay, book lessons, or see contacts shared in a league; you can still enter and edit household and player details. If you do not want to accept a new version, you may stop using Callback and ask us to delete your account.
13. Callback's responsibility to you
Callback does not run any club's programs or lessons and is not responsible for them, for a club's waivers, or for a club's decisions about registrations, bookings, cancellations, or refunds.
We work to keep Callback available and accurate, but we do not promise that it will be uninterrupted or free of errors. To the extent permitted by law, Callback is not liable for indirect, incidental, special, or consequential damages, or for lost profits. These limits do not apply to fraud, wilful misconduct, gross negligence, or death or personal injury caused by our negligence.
To the extent permitted by law, Callback's total liability to you arising out of these terms or your use of Callback is limited to $100 or, if greater, the total of Callback's fees on the payments you made through Callback in the 12 months before the event that gave rise to the claim. Some places do not allow some of these limits, so they may not apply to you. Nothing in these terms limits a right that the law says cannot be limited.
14. Disputes and governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Callback will bring any claim against you in the state or federal courts in Maricopa County, Arizona, or in the courts where you live. You may bring a claim against Callback in those Maricopa County courts, in small-claims court, or in the courts where you live. A dispute between you and a club is between you and the club.
15. Deleting your account and your information
You may stop using Callback at any time. To delete your account, email support@mckerinsoftware.com from the account's email address. Callback deletes it once nothing at a club depends on it: for example, if you are the only guardian who can manage a player, the club first deletes the player or gives another guardian that right. A household that only you belong to is deleted with your account. The registrations you made are kept for the club, with your name and email address removed, and so are the records of waivers you signed, with your typed name and your account removed from them. A club that deletes a player or a household deletes its registrations and waiver signatures. To have a player or a household deleted, ask the club. Some records are kept after a deletion, and some copies are outside Callback; the Privacy Policy explains what is deleted, what is kept, and for how long. If a club stops using Callback, its information is deleted as the Privacy Policy describes, and so is a family account that was used with no other club. We will email the account before we delete it.
16. General
If any part of these terms cannot be enforced, the rest still applies. These terms do not change any agreement between you and a club.
